When you visit myBROWNS or make use of our services you automatically receive one or more cookies. The primary purpose for our use of cookies is to ensure the optimal delivery of our services. In addition, we use third party cookies for statistics and to analyse user behaviour. This policy explains in more detail the types of cookies we use, the purposes for which we use them and how you can block and remove such cookies.
What is a cookie?
A cookie is a small file, typically of letters and numbers, downloaded on to a device when the user accesses certain websites. Cookies are then sent back to originating website on each subsequent visit. Cookies are useful because they allow a website to recognise a user’s web browser or device.

Our use of cookies
Cookies on our platform may be set by us or by third parties under contract with us.
Our site makes use of both ‘session’ and ‘persistent’ cookies. ‘Session’ cookies remember information from page to page before being removed when you end your session. ‘Persistent’ cookies enable our Site to recognise you when you make return visits to us, and remain stored on your computer until deleted, or until they reach a specified expiry date. Persistent cookies placed on your computer as a result of your use of our websites will never be stored for longer than 2 years from the date of your last visit.

BROWNS English Language School Pty Ltd - Registered with the Australian Government ABN: 31 111 453 831 - CRICOS Provider No: 02663M welcomes you (the “user” or “you”) to its website/platform (the “Site”). The terms "BROWNS" or "we" refer to BROWNS English Language School Pty Ltd.
BROWNS complies with the Privacy Act 1988 (Cwth) (Privacy Act) which protects the privacy of your personal information. The purpose of this statement is to let you know what information is collected about you and how the information is used when you visit a BROWNS website, or provide your details directly to us, for example by email or by completing our online or hard copy forms.
Automatic Collection of Information
BROWNS automatically collects certain information when you visit our Sites, some of which may be capable of personally identifying you. Such information includes the type of browser you are using, the type of operating system you are using, your IP address and how you use our website.

Personal Information
Personal identifying information you supply on-line via online application forms, surveys, enquiries and email, will be used by BROWNS staff in conducting the business of the company. Such uses include matters relating to student administration, provision of services to you, responding to your enquiries, and providing you with information about our courses and services.
Types of Personal Information
The personal information that BROWNS collects and hold generally includes your name, address, date of birth, and contact details (such as your phone number and email address). With your express consent, BROWNS may also collect and hold certain sensitive information relating to your racial or ethnic origins or your health for the purposes of providing services or assistance to you and to meet our reporting obligations to State and Australian Government agencies.
Your personal information, including sensitive information, will only be used for purposes consistent with the original purposes of collection. By law, you are not required to provide BROWNS with your personal information. However, if you do not do so, you may not receive the full benefit of the complete range of services offered by BROWNS.
Use of Personal Information
BROWNS uses the personal information you provide to:
- Communicate with you and respond to your enquiries
- Carry out day to day administrative matters
- Inform you about events and activities relevant to your course, and other courses, services and opportunities that are available from BROWNS and our affiliates
- Maintain your academic record
- Assist us in providing courses for the health and welfare of students
- Keep alumni informed of events and opportunities that may be of interest to them through regular mailouts
- Fulfil our State and Commonwealth Government reporting and statistical obligations
- Assist in forecasting future needs of our products and services, and
- Any other purposes identified at the time of collecting your information.
Disclosure of Personal Information
Information collected from you may be disclosed to third parties in limited circumstances expressly permitted in the Privacy Act, for example to State and Commonwealth Government Agencies as required or authorised by law.
Personal information may also be disclosed to:
- External organisations such as professional bodies, work-placement providers, and third parties engaged to act on behalf of BROWNS
- Other educational institutions in the BROWNS network so that they can also offer you information and services (if you have opted-in to receive such information)
- Our IT, infrastructure and operations service providers
- Third-party providers of student services, and
- Any other entities identified at the time of collecting your personal information.
Where personal information is to be provided to contractors or other external organisations, BROWNS will require the recipient (and any contractor engaged by the recipient) to manage the information in a manner consistent with the Privacy Act.
Security of Information
BROWNS takes reasonable steps (including any measure required by law) to ensure your personal information is protected from loss, misuse, interference and unauthorised access, alteration or disclosure.
However, data protection and security measures are never completely secure and, despite the measures BROWNS has put in place, BROWNS cannot guarantee the security of your information. You must take care to ensure you protect your personal information (for example, by protecting any usernames and passwords, etc.) and you should notify us as soon as possible after you become aware of any security breaches.

Accuracy, Access and Correction
BROWNS takes all reasonable steps to ensure that the personal information that it collects and hold is accurate, complete and up-to-date. However, BROWNS relies on you to advise us of any changes to your personal information to help us maintain our records.
BROWNS will, on request, provide you with access to the personal information it holds about you unless otherwise required by law. BROWNS will notify you of the basis for any denial of access your personal information.

BROWNS will investigate the issue and determine the steps (if any) that BROWNS will undertake to resolve your complaint. BROWNS will contact you if it requires any additional information from you and will notify you in writing of the outcome of the investigation. If you are not satisfied with BROWNS determination, you can contact BROWNS to discuss your concerns or complain to the Australian Privacy Commissioner via www.oaic.gov.au.

BROWNS reserves the right to revise this Privacy Statement or any part of it from time to time. Please review this Privacy Statement periodically for changes.

The terms "BROWNS" or "we" refer to BROWNS English Language School Pty Ltd. References to the Site are deemed to include derivatives thereof, including but not necessarily limited to websites and applications, whether accessed by mobile phone, tablet or other devices. The Terms of Use –as defined below- apply to our services, directly or indirectly made available to you through whatever means, including online bookings, customer service requests or otherwise. By accessing, browsing and using the Site and/or by submitting an application or enquiry through myBROWNS, you acknowledge and agree having read, understood and agreed to the Terms of Use. Our different policies and guidelines, which can be found throughout the Site, including but not limited to, the Privacy Policy and Cookie Policy (collectively the “Policies”), should be read in conjunction with and are an integral part of these terms and conditions and are hereby included by reference. The Terms of Use set out below and the policies are collectively referred to as the “Terms of Use”. If you do not agree to the Terms of Use, please cease use of the Site immediately. The Terms of Use – as may be amended from time to time – constitute the entire agreement, and supersede any other agreements or understandings (oral or written), between you and BROWNS English Language School with respect to their subject matters unless explicitly stated otherwise.

Using myBROWNS Services
You may only use the myBROWNS Services/Platforms in compliance with applicable laws and for legitimate purposes. In consideration of you agreeing to abide by these Terms, we grant you a non-transferable, non-exclusive licence to access and use myBROWNS subject to you agreeing that you shall not:
- use myBROWNS for any purpose that is improper, unlawful, or to post, share or transmit any material that (i) is defamatory, offensive, obscene or otherwise objectionable; (ii) is in breach of confidence or privacy or of any third party’s rights including copyright, trade mark or other intellectual property rights; or (iii) is misleading or misrepresentative as to your identity or which in any way suggests that you are sponsored by BROWNS.
- use myBROWNS in any manner which may cause damage to BROWNS or bring BROWNS into disrepute;
- disassemble, reverse engineer or otherwise decompile any software, applications, updates or hardware contained in or available via myBROWNS, except as permitted by law;
- copy, distribute, communicate to the public, sell, rent, lend or otherwise use myBROWNS or seek to violate or circumvent any security measures employed to prevent or limit your access to or use of myBROWNS;
- use or interfere with myBROWNS in a way that could damage, disable, overburden, impair or compromise our systems or security or interfere with other users;
- introduce onto, or transmit via, myBROWNS any disruptive computer program code, virus, ‘denial of service’ or ‘spam’ attack, worm, Trojan horse, authorisation key, licence control utility or software lock;
- use any automated computer program or application to scan, copy, index, sort or otherwise exploit myBROWNS or any part thereof.
Where you sign up to any feature of, or use, myBROWNS that requires the use of a log-in account or password, you agree that you shall be responsible for keeping those password and log-in details confidential and secure. If you become aware, or suspect for any reason, that the security of your log-in details has been compromised, please let us know here as soon as you can.
To the extent that any element of myBROWNS is hosted on a third party website (for example, Facebook or another social media website) and there are separate terms and conditions of use relating to that third party website, you agree to fully comply with such terms and conditions.
Sharing information with us
We take your privacy seriously and operate at all times in accordance with applicable data protection laws. You acknowledge that any personally identifiable information which you submit to or via myBROWNS may be used by us in accordance with our Privacy Policy. You agree to ensure that all personally identifiable information you provide to us is accurate and up to date and that you have obtained all consents, licenses or approvals necessary to enable us to use that information in accordance with these Terms and with our Privacy Policy.
To the extent that you provide us with any suggestions, comments, improvements, ideas or other feedback (“Feedback”), you hereby assign ownership of all intellectual property rights subsisting in that feedback to us and acknowledge that we can use and share such Feedback for any purpose at our discretion. BROWNS property
Except as set out elsewhere in these Terms, all intellectual property rights including, but not limited to, copyright (including copyright in computer software), patents, trade marks or business names, design rights, database rights, know-how, trade secrets and rights of confidence in myBROWNS (together, the "Intellectual Property Rights") are owned by or licensed to BROWNS. You acknowledge that by using myBROWNS, you will not acquire any right, title or interest in or to myBROWNS or in or to the Intellectual Property Rights except for the limited licence to use myBROWNS granted to you pursuant to these Terms. You further acknowledge that you have no right to have access to any aspect of myBROWNS in source-code form.
Other people’s property
We respect the intellectual property rights of others. If you have reason to believe that your copyright is being infringed by any content on myBROWNS, please send a written notification of such infringement here.
Your liability to us
Subject to these Terms, you will be responsible and liable to us for all actions, claims, proceedings, costs, damages, losses and expenses (including, without limitation, legal fees) incurred by us, and each of our officers, directors, employees and agents, arising out of, or in any way connected with, your use of myBROWNS or breach of these Terms.
Termination
BROWNS may in its absolute discretion immediately terminate any agreement with you under these Terms at any time upon notice to you and/or, if you have a log-in account, by cancelling your membership and your access to your account. BROWNS may suspend your use of myBROWNS without notice at any time, without incurring any liability to you whatsoever.
General provisions
You acknowledge that your unauthorised use of myBROWNS may result in irreparable damage and injury to BROWNS and/or its affiliates for which money damages would be inadequate. Consequently, in the event of such unauthorised use, we and our affiliates (as applicable) shall have the right, in addition to any other legal remedies available, to seek an immediate injunction against you prohibiting any further use myBROWNS.
The invalidity or unenforceability of any provision (in whole or part) of these Terms shall not affect the validity or enforceability of the remaining provisions (in whole or part). The whole or part of any provision which is held by a court of competent jurisdiction to be invalid or unenforceable shall be deemed deleted from these Terms.
These Terms are personal to you. You shall not be entitled to assign these Terms in whole or in part to any third party without our prior written consent. These Terms represent the entire agreement between us and you and supersede and replace all and any previous terms, conditions, agreements and arrangements in respect of your use of myBROWNS.
We will act promptly to any indications of user content that is in breach of these Terms. Where you know of or suspect any illegal activities, or know of or suspect that works belonging to you have been infringed, please contact us here.
Any failure by us to enforce any of these Terms shall not be considered to be a waiver of them or the right to subsequently enforce any of these Terms.
A person who is not a party to these Terms shall have no right to enforce any provision of these Terms.
Irrespective of the country from which you access or use myBROWNS, to the extent permitted by law these Terms and your use of myBROWNS shall be governed in accordance with the laws of Australia and you are deemed to have submitted to the non-exclusive jurisdiction of the courts of Australia to resolve any disputes which may arise hereunder.
